At the December 14 hearing, the court will determine whether probable cause exists to continue the case against Mr. Curl. Rianda v. Golden West Swim Club, Golden West Swim Club Support Group, and Mark Schubert
According to the Superior Court of Orange County, California, on December 17 the court will hold a hearing on Mr. Schubert’s and Golden West Swim Club’s request to dismiss Ms. Rianda’s complaint against them for wrongful termination, retaliation, fraudulent inducement, negligent misrepresentation, and general negligence. Ms. Rianda has brought this action against these two parties, as well as Golden West Swim Club Support Group, as a result of her employment with and subsequent termination from the Swim Club. Richard Foster represents both Mr. Schubert and the Swim Club. Mr. Foster contends that Ms. Rianda fails to state any facts in her complaint that prove the Swim Club took any action or failed to take any action that resulted in her alleged claims for damages.
